DEFINITIONS

The Promoter – CompCity Limited, t/a CompCity Giveaways company number 13005436 are the sole promoters, registered address is Excalibur House Priory Drive, Langstone, Newport, Wales, NP18 2HJ.

Entrant – Any person / or persons who enter a prize draw through the website or via post to win a prize.

Entries – When entering a prize draw competition, the entrants agree they have read and accepted the following terms and conditions.

Prize – CompCity Limited run skill-based prize competitions that result in a specific prize being offered to the winner. Some competitions will offer runner up prizes.

All prizes offered will be deemed as new, however, some products may have been opened or removed from packaging due to reasons such as; product testing or product shoots. In the circumstance a prize falls under a ‘condition’ listed as the above then the prize is still deemed as ‘new’.

Competition Question – This must be answered correctly for your entry to be entered into the draw.

Closing Date – Closing date for entry will vary but be clearly displayed on the CompCity webpage. After this date the no further entries to the competition will be permitted.

Maximum number of entries: The maximum number of entries that can be made by any one person is limited to 10 per competition, unless otherwise stated on the competition page.

Winner – The winner (entrant) chosen at random on or after the closing date will receive the prize/ prizes in accordance with these terms and conditions.

GENERAL

Once entered into the competition, the entrants must submit all contact details as requested by the Promoters. Included in this is a valid email address and telephone number, the entrants contact details will be used for the following purpose:

(a) To notify the winner that they have won


(b) To post the winners name and place of residence on the website


(c) To comply with the Privacy Policy


(d) To post the draw number for everyone who has entered on our Facebook page.

Only the entrants name and nothing else will appear on live draws and number lists, this is to show everyone’s numbers during the live draw. All entrants are solely and completely responsible for providing the promoters with accurate and current contact details. Competitions are open to persons aged 18 or over who are resident in The United Kingdom of Great Britain and Northern Ireland (UK). If you enter from outside of the UK then further terms are applicable below.

By signing up you are agreeing to be contacted via telephone / sms by CompCity Giveaways to support your experience on the website. You can opt out of this communication using the Opt out links provided on the communications or by emailing [email protected].

Automated or robotic Entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the Entrant. Any attempt by Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/competition subscription notification and/or entering services, will void Entrant’s Entries and that Entrant may be disqualified. The entrant and the promoter recognize that the competition, its administration and all associated activities are governed by English Law, and the promoters and entrants recognize that the County or High Courts of England shall have exclusive jurisdiction in the event of a dispute arising out of the competition or its administration. By entering the competition, entrants warrant that all information which they submit is accurate, true, current and complete. The promoters reserve the right to disqualify any entrant (at their own discretion) if there are reasonable grounds to believe that the entrant has acted in breach of the terms and conditions.

By entering, you confirm that you are not breaching any laws in your country of residence. The promoter will not be held responsible for any entrant entering any of our competitions unlawfully. If in any doubt, you must immediately leave the website and check with the relevant authorities in your country. By entering into the competition, all entrants acknowledge that their payment per entry does not guarantee in any way that they will win a prize. To the extent permitted by applicable law, All entries will become the property of the promoters on receipt and will not be returned. The promoter does not imply or give any warranty or accept any valuation to the prize. The entrant must make their decision through their own inquiries and legal advice before entering the competition. The promoters reserve the right to amend these terms and conditions at any time and for any reason.

To include any entry into the competition, an entrant will be asked to provide their contact details (including postal and e-mail addresses and a mobile number) and card payment details (for entry fee only). Once the entry has been submitted, the entrant’s card payment will be electronically approved. 

All competitions are skill-based competitions. Entry fees for online entries are payable each time you enter.

To be in with a chance of winning, everyone who enters the competition (an “Entrant”) will be required to correctly answer a question or solve a problem set by the Promoter (the “Competition Question”).

To enter the competition: 

(a) go to the Website and view the Competition Question;

(b) select your answer to the competition question and required number of entries; then

(c) complete the checkout process and submit the online entry form; then

(d) complete the payment to receive your order confirmation.

Unless you are using the free entry method, the Promoter will send confirmation that your entry has been received, and your allocated ticket number.

Refund Policy
No refunds of the entry fee will be given in any event, including:

(a) if, following your entry into the competition, you subsequently find out that you are not eligible to enter the competition or claim the Prize, this includes if you are rude or abusive to the Promoter or anyone associated with them;

(b) if, following your entry into the competition the eligibility criteria for entering the competition or claiming the Prize changes and you are no longer eligible; or

(c) if you are disqualified from the competition by the Promoter for any reason.

The promoters will not accept responsibility for entries which they do not receive due to computer system failure, other malfunctions, high internet traffic, hardware, software or server failure or any other reason. The competition rules will not be construed as a contract, joint venture or other agreement between the entrant and the promoters. An entry will be declared void should the promoters believe that the entrant is acting in any way fraudulently (actual or apparent), any fraudulent misrepresentation, fraudulent concealment, hacking or interfering with the functioning of the website. Such misuse of the website can result in the users account being permanently banned.

FREE ENTRY

For those who would like to enter the competition for free, you must send a handwritten entry on an unenclosed picture postcard (all information displayed on one side) by first or second class post to the promoter, hand delivered entries will not be accepted and will not be entered into the random draw. It must be clear and easily readable stating the exact competition you are entering, the answer to the question specific to that particular competition along with your personal details as follows:

Full name, date of birth, postal address, email address, one contact number and agreement to terms and conditions.

Postal entries are limited to one entry per person for each competition. Bulk entries in one envelope will not be accepted as multiple entries and if a bulk entry is received, it will be counted as one single entry. The availability of a free entry route to enter each competition means that the competition does not fall within the definition of gambling under the Gambling Act 2005 and can be operated legally in Great Britain without any need for a licence. All free entries must be received before the close of the competition, any entries that fail to follow the criteria mentioned above will be void as per any entry received. Entrants must have an active account on our website at the time the free entries are processed, all the details on the postal entry must match those on the account of the entrant.

All entries must be sent to: CompCity Giveaways, Excalibur House Priory Drive, Langstone, Newport, Wales, NP18 2HJ. Postal entries received while the competition is open will be entered into the random draw and will be treated exactly the same as a paid entry.

A member of CompCity Giveaways will check the mail for all free entries on Mondays and Thursdays only. No liability is accepted for incomplete or late entries. No responsibility is accepted for entries lost that do not arrive at the promoters address, or any entries that are damaged or delayed or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt. If the number of entries reaches any cap or limit before your free entry is received via post, you will not be entered into the prize draw. The Promoter will not acknowledge receipt of your entry nor confirm if your answer to the Competition Question is correct.

Your entry must be received by the Promoter prior to the Closing Date. Entries received after the Closing Date will not be entered into the random draw.

In the interest of fairness, The Promoter reserves the right to ban anybody that is suspected of misuse, cheating or automating entries. Any automated entries or suspected automated entries will not be accepted and anybody suspected or deemed to be attempting to make automated entries will be permanently banned from Compcity Giveaways. Automated entries can include but is not limited to; printing post cards in volume, use of a franking machine or use of business postage solutions.

If you are entering an Instant Win Competition through the Postal Entry Route, following receipt of your valid postal entry we will email a site credit coupon to your email on account. You must use this site credit coupon to enter an Instant Win Competition via the Website and receive a ticket to be in with a chance of winning a prize.

The Promoter will email each Entrant who has submitted a valid entry via the Postal Entry Route to (i) if entering a Draw Based Competition, confirm their ticket number; or (ii) if entering an Instant Win Competition, their site credit coupon.

VALIDATION

The Promoter hereby reserves the right not to give or make a Prize until it is satisfied that:

(a) the Winner has a validly registered Website account and/or is not in breach of these terms and conditions,

(b) any and/or all amounts due or owing by you to the Promoter have been paid in full,

(c) the identity of the Winner and his or her entitlement to receive the Prize has been established to the Promoter’s satisfaction (in particular, the Promoter reserves the right to request documentary proof of identity and not to give or make a Prize until satisfied appropriate proof of identity has been provided), and

(d) the Promoter may require proof of age to be produced before giving or making a Prize. Prizes will not be given or made to Winners found to be under the age of 18.

Without prejudice to the rule above, the Promoter reserves the right not to make or give a Prize if it reasonably suspects the occurrence of fraud in relation to a Competition. The Promoter may, at its absolute and sole discretion, give or make a Prize to a person whom it is satisfied is the duly authorized representative of the Winner acting under a lawfully executed power of attorney or other equivalent authorization.

The promoters reserve the right to cancel the competition at any time either before or after tickets have been sold. If the competition is cancelled, the promoters will return the entry fee to each entrant.

PC COMMUNICATIONS

No responsibility will be accepted by the Promoter for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes. The Promoter shall use its reasonable endeavours to award the Prize for a Competition to the correct Entrant.

If due to reasons of hardware, software or other computer related failure, or due to human error, the Prize is awarded incorrectly, the Promoter reserves the right to reclaim the Prize and award it to the correct Entrant, at its sole discretion and without admission of liability and the Entrant that has been incorrectly awarded the Prize will immediately at the Entrant’s own cost and expense return it to the Promoter and/or pay the Promoter for that Prize (at the option of the Promoter). The Promoter shall not be liable for any economic and/or other loss and/or consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due to such persons.

The Promoter shall use its reasonable endeavours to ensure that the software and Website(s) used to operate its Competitions performs correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the Ticket recorded in our systems, however displayed or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any Competition Entries that occur as a result of malfunctioning software or other event.

CLOSING THE COMPETITION

A competition will close when all of the advertised tickets have been sold or on the competition end date.

If the competition end date is reached and there is still unsold tickets, the draw will happen regardless.  The closing date that is specified at the start of the competition will not be extended.

In some circumstances we may bring the date FORWARD as a promotion meaning the competition will run for a shorter time than originally planned. In this instance the new, earlier date set is binding and will not be extended.

THE WINNER

Draw Based Competitions: All Entrants who correctly answer the Competition Question will be placed into a draw and the winner will be chosen by a verifiably random draw process. The entry lists will be published on the website (www.compcitygiveaways.co.uk/entries) before the live draw, showing every entrants ticket number, first name and last name. During the live draw this entry list will be shown and the winning ticket number will be selected at random using Google’s Random Number Generator live on our Facebook Page @CompcityUK (Compcity Giveaways), Youtube and Twitch TV. In the event of the draw being disrupted for any reason or having an inconclusive outcome, we can at our sole and unfettered discretion run the draw again, either through the same random draw process or an alternative method. 

The winner will be notified that they have won as soon as practicable after the live draw and the prize will be posted within seven days of the draw unless the prize is a pre-order, if so the prize will be posted once the pre-order is fulfilled by the supplier.

Instant Win Competitions: All Entrants who have entered an Instant Win Competition will be assigned a ticket. Winning tickets will be selected prior to the start date of the draw. Ticket Assignment and Winning Ticket Selection will both be performed using a verifiably random process.

The winner of a Prize in an Instant Win Game will receive an email and must follow the instructions contained in that email in order to claim the Prize.

The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the full name and county/town of residence of major prize winners on the Website/social media unless you object in accordance with the below paragraph.

You must claim the Prize personally. The Prize may not be claimed by a third party on your behalf. Any Cash Prize will be transferred directly to the Winner’s nominated bank account. Details of how the Prize will be delivered to you (or made available for collection) are published on the Website, or available on request.

All Winners will be asked for their consent by the Promoter to provide photographs and/or pose for photographs and videos and have their personal details (including details of any Prize won by them) included in marketing material. If a Winner consents to the above, the foregoing photographs, videos and marketing material may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a Winner of a Competition.

If you are the winner of the competition, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the Prize and transfer ownership of the Prize to you. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may also withdraw your consent to your personal information being used in such way but by doing so you may prevent the Prize being transferred to you. In such circumstances, you will be deemed to have withdrawn from the competition and forfeit the Prize. You will not be entitled to any refund of your entry fee. The Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.

The promoters will be in no way liable for any failure or inability to contact any entrant due to errors, omissions or inaccuracies in the contact details provided by the entrant. If for any reason the Promoter is unable to contact a Winner within 7 working days (which may be extended at the sole discretion of the Promoter) of the end of a Competition, or the Winner fails for whatever reason or cause to confirm acceptance of the Prize and/or the Winner is disqualified as a result of not complying with or contravening any of these terms and conditions, the Winner hereby agrees that it will immediately, irrevocably and automatically forfeit the Prize and the Prize will remain in the possession and ownership of the Promoter and then the promoters will be entitled to award the prize to the entrant selected by drawing another random entry.

This will be the ‘Alternate Winner’, who will have 7 working days from notification of their status to accept the prize.

The decision of the Promoter is final and no correspondence or discussion will be entered into.

The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the prize.

If the Prize is a vehicle and the winner has completed all eligibility checks, the prize will be transferred to the winner by the Promoter using the V5 for each vehicle. This must be completed before the vehicle is handed over.

If Promoter fails to comply with these terms and conditions, Promoter is responsible for loss or damage you suffer that is a foreseeable result of Promoter’s breach of these terms and conditions or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of the promoter’s breach or if they were contemplated by you and the Promoter at the time that you entered the competition.

PRIZE & WARRANTY

There may be one or more prizes available for each competition, which are described on the relevant competition pages of the Website. Details of the Prizes are, to the best of the Promoter’s knowledge, information and belief, correct as at the Opening Date. Non-cash Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value. If any details of the Prize change, the Promoter will endeavour to update the Website as soon as reasonably possible.

The prize will come with no direct warranty from the Promoter. For certain prizes, the manufacturer may offer a warranty.  It is the winners responsibility to pursue the warranty with the manufacturer in this case. The Promoter does not in any way guarantee the value of a prize. The entrant must make up their own decision through their own enquiries and advice before entering a competition.

If a prize does develop a fault, it is the whole responsibility of the winner to exercise correct diagnostic procedures and consult local technology repair specialists to advise on solutions and seek advice to determine whether manufacturer warranty claims are required. No diagnostics or repairs will be carried out by the Promoter of the competition. Serial numbers of prizes, including any internal components of all prizes are documented and saved by the Promoter to prevent any unlawful behaviour.

If the Prize is a vehicle:

The Promoter will, unless otherwise stated, ensure it comes with a valid MOT (if required). No insurance is included with the Prize and it is the Winner’s responsibility to ensure the vehicle is adequately insured prior to taking it on the public roads (if it is legal to do so). 

The Promoter has no responsibility for the Prize(s) once it has been delivered. The Winner is solely responsible for complying with all relevant laws and regulations relating to the vehicle, its operation and ensuring they operate it in a safe and responsible manner.

No vehicle/road tax is included.

The Winner is solely responsible for ensuring they have all necessary safety equipment and clothing (for example, helmets, boots and gloves) and for wearing them whilst operating the vehicle.

Other non-cash Prizes may be subject to additional conditions, which will be set out on the relevant competition page of the Website.

The Prize may be supplied by a third-party supplier. Details of the Supplier will be provided on the Website or via Social Media pages.

The Promoter reserves the right to substitute the Prize for an alternative cash prize in the following circumstances:

(a) the Prize becomes unavailable;
(b) other circumstances beyond the reasonable control of the Promoter make it necessary to do so;

The prize is not negotiable or transferable and all costs and expenses not included within the Prize are the responsibility of the Winner.

DELIVERY POLICY

Delivery of prizes (excluding vehicles) is completely free of charge. Prizes that include a desktop computer system, will be delivered by the Promoter themselves at a prearranged appointment with the winner if possible or will be shipped fully insured. Prizes that do not include a desktop computer system (laptops, components and some bundles) will be posted free of charge using a reliable, tracked and insured courier company. Delivery of the Prize to the Winner’s home address in Great Britain is free. The Promoter has a right to and/or may charge the Winner delivery fees if they require the Prize to be delivered to an address outside Great Britain.

If the prize is a vehicle, collection of the prize is required and is solely the responsibility of the winner from the promoter’s address (All Entrant expenses to collect the Prize are the sole responsibility of the Winner). Once a prize is handed over to a winner (collected or delivered), is it the complete sole responsibility of the entrant to ensure safe transit of a prize to its destination. No alternate prize will be offered if loss or damage results after the initial hand over.

DATA PROTECTION

By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used by the Promoter or its agents and suppliers for the purposes of administering and managing the competition and prizes and of informing you of future competitions and our competition schedules according to these Terms and Conditions.

If you do not agree to participate in any publicity as covered in section 7 we may still provide your details to the Advertising Standards Authority. This is a legal requirement that we must comply with to prove that the competition has been properly administered and the Prize awarded.

The entrants and the promoter also recognise that the promoter may also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.

Please note that under data protection laws you are entitled to request that the Promoter does not contact you and removes your details from its database. If you make such a request you will be withdrawing from the competition as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry fee if you withdraw from the competition. If you do not wish any of your personal details to be used by the Promoter for promotional purposes, please email the Promoter at [email protected]

Store Credit & Coupons (Vouchers)

General Information

These Terms apply to every store credit / coupon you win or are given from CompCity Limited, referred to here as a “Voucher”.

Voucher means an instrument, in either physical or electronic form, which entitles the holder of such Voucher (the ‘Voucher Holder’) to receive the Offering during the period of time stated on the Voucher (the ‘Redemption Period’).

The Offering shall mean the store credit or discount coupon to be provided by CompCity Limited, to the Voucher Holder, as specified on the CompCity Limited Site and on the Voucher communication.

Unless expressly stated otherwise:
(a) the Voucher can only be redeemed once;
(b) you must follow the redemption instructions associated with the Voucher on the voucher email or communication from CompCity Limited, when you redeem it.

In order to redeem a Voucher you must enter it in to the coupon section of the basket or checkout, within the Redemption Period. If you do not redeem the Voucher within the Redemption
Period, the Voucher expires automatically. It cannot be redeemed anymore and you are not entitled to any reimbursement or compensation.

You promise not to provide false data including false names, addresses and/or contact details; or engage in any unlawful activity in connection with the use of a Voucher, or allow anyone else to do so. If you find that a voucher is not working as intended or issueing more credit that you won, you must cease use of it and let us know straight away, or you will be liable for any entries gained from misusing a coupon code.

Any attempt to redeem a Voucher contrary to these Terms may render a Voucher void at CompCity Limited’s discretion.

Any misuse, exploitation or redemption fraud of vouchers will be taken seriously and legal action will be taken against you.

The reproduction of a Voucher is prohibited. Each Voucher contains a unique reference code, which can only be redeemed as instructed by CompCity Limited. Once a Voucher has been redeemed, the unique reference code will no longer be valid.

The commercial trade of a Voucher is prohibited.

Unless otherwise stated within these Terms, notices to be given to either party shall be in writing and shall be delivered by electronic mail. Any notice that CompCity Limited sends to you will be to the address you supplied to CompCity Limited when you completed your order. You can send any notice to CompCity Limited at the registered office address as set out in section 1.
